The research aims to deepen theoretical and methodological foundations of ADR in this field, analyze key EU regulations, and explore the prospects of mediation and arbitration in transnational disputes. Key EU regulations, including Directive 2008/52/ EC, Regulation (EU) No. 1215/2012, and others, are analyzed. The study identifies ADR’s advantages for both the EU and Ukraine’s national economy. It highlights the key features of mediation, such as voluntariness, confidentiality, flexibility, economic efficiency, and business orientation, and the arbitration mechanism in transnational IP disputes.
