dc.description.abstractenThe article is devoted to the study of a democratic political regime, which directly means “rule of the people”. The analysis is made in terms of this regime as a legal phenomenon and a political regulator. The meaning of the concept of “democracy” is revealed. The relevance of this study lies in the great popularity of democracy in many countries around the world, including Ukraine. Through theoretical and practical analysis of democracy, the main paradoxes and contradictions that hinder the implementation of effective policy have been clarified. One of the forms of realization of this political regime is analyzed, namely – the electoral process. An example of the contradictions that arise in the electoral process of foreign countries is the recent election of the President of the United States in 2020, namely the policy of Republican Donald Trump and the implementation of reforms of Democrat Joseph Biden. The events that had a great impact on the results of the election of the new President of the United States of America in 2020 are highlighted. The contradictions of the election process in Ukraine have also been clarified. A widespread problem in Ukraine's election process is the implementation of corruption due to the fact that Ukraine is still dominated by the post-Soviet model of society, ie now the country is in transition to an ideal democratic model. It is analyzed in which normative-legal act the content of consolidation of democratic policy of Ukraine is revealed, namely that the bearer of power is the people, and also in what position this content is violated. The principles on which this process should be based for realization of a policy of democracy in its qualitative realization are formed. Based on the legal analysis of this political phenomenon, the main problems of democracy, the reasons for their emergence and proposed methods of overcoming are clarified. The main contradictions that have been clarified will help resolve the causes of the conflict between the democratic regime and its constitutional consolidation.uk
dc.description.abstractukСтаття присвячена дослідженню демократичного політичного режиму, який безпосередньо означає «правління народу». Аналіз зроблений із погляду цього режиму як правового явища, так і політичного регулятора. Розкритий зміст поняття «демократії». Актуальність поданого дослідження полягає у великій популярності народовладницької політики в багатьох країнах світу, в тому числі й в Україні. Завдяки теоретичному і практичному аналізу демократії з’ясовано основні парадоксальності та суперечності, що заважають здійсненню ефективної політики. Проаналізовано одну з форм реалізації цього політичного режиму, а саме виборчий процес. Прикладом щодо суперечностей, які виникають у виборчому процесі іноземних країн, проаналізовано останні вибори Президента Сполучених Штатів Америки 2020 року, а саме проблематику політики республіканця Дональда Трампа і впровадження реформ демократа Джозефа Байдена. Виокремлено події, що мали великий вплив на результати виборів нового Президента Сполучених Штатів Америки 2020 року. Також з’ясовано суперечності виборчого процесу в Україні. Проблемою, що набуває великого поширення у виборчому процесі України, є здійснення корупції через те, що в Україні ще панує пострадянська модель суспільства, тобто країна знаходиться на перехідному етапі до ідеальної демократичної моделі. Проаналізовано, в якому нормативно-правовому акті розкрито зміст закріплення демократичної політики України, а саме те, що носієм влади є народ, а також в якому положенні цей зміст порушується. Сформовано принципи, на яких має базуватися цей процес задля реалізації політики народовладдя в її якісному втіленні. На основі правового аналізу цього політичного явища з’ясовані основні проблеми здійснення демократії, причини їх виникнення та запропоновані методи подолання. З’ясовані основні суперечності допоможуть вирішити причини конфлікту демократичного режиму та її конституційного закріплення.uk
