dc.description.abstractenThe article explores the concept of marriage contract and it’s main features are highlighted. The essence of the marriage contract and the purpose of it’s conclusion have been found out. The procedure for the conclusion of the marriage contract in Ukraine and the United States of America is analyzed in detail, the Ukrainian and American legislation on the content and procedure of the marriage contract are compared. The place of marriage contracts in the life of representatives of American society has been revealed. The gaps of the current legislation are identified, the main advantages and disadvantages of marriage contract in Ukraine are highlighted. The article concludes that it is necessary to improve the Ukrainian legislation related to the process of creating marriage agreements that regulate the main aspects of family relationships. The article also analyzes the results of the survey of the population on the issues of awareness of Ukrainians in the nuances of contracting, the expediency of the existence of this procedure and the attitude of respondents to the existing possibility of signing a marriage contract. According to the results of the study, it is concluded that the attitude of the Ukrainian population to the right to conclude a marriage contract is ambiguous and requires detailed study by experts in the field of law. The marriage contract is described as a mechanism of influence on family relations and the place of this document in the married life is evaluated. The analysis of the categories of the population most often using the possibility of entering into a marriage contract. The actuality of the existence of the Institute of Marriage Contracts at the present stage of society development is analyzed. The scientific views which have developed in the legal science concerning the main positive and negative aspects of the existence of the marriage contract procedure have been investigated. The article concludes that the stereotypes existing in society about the consequences of signing a marriage contract are false. The system of recommendations for improvement of the existing legislative base, which regulates the concept of marriage contract and peculiarities of the procedure of its conclusion, has been developed. Options for a possible legislative definition of the term "marriage contract" are suggested.uk
dc.description.abstractukУ статті досліджено поняття шлюбного договору та виділено його основні ознаки. З’ясовано сутність шлюбного договору та мету його укладення. Детально проаналізовано порядок укладення шлюбного договору в Україні та Сполучених Штатах Америки, здійснено порівняння українського та американського законодавства щодо змісту та процедури укладення шлюбного договору. Виявлено місце шлюбних договорів у житті представників американського суспільства. Визначено прогалини чинного законодавства, виділено основні переваги та недоліки укладення шлюбного контракту в Україні. У статті зроблено висновок щодо необхідності вдосконалення українського законодавства, пов’язаного з процесом створення шлюбних договорів, що регулюють основні аспекти сімейних відносин. Також у статті проаналізовано результати опитування населення з питань обізнаності українців у нюансах укладення контракту, доцільності існування даної процедури та ставлення опитуваних до існуючої можливості підписання шлюбного договору. За результатами дослідження зроблено висновок, що ставлення українського населення до права на укладення шлюбного договору є неоднозначним і потребує детального вивчення фахівця ми у сфері права. Надано характеристику шлюбного договору як механізму впливу на сімейні відносини та здійснено оцінку місця цього документа в подружньому житті. Здійснено аналіз категорій населення, що найчастіше користуються можливістю укладення шлюбного договору. Проаналізовано актуальність існування інституту шлюбних контрактів на сучасному етапі розвитку суспільства. Досліджено наукові погляди, що склалися в юридичній науці стосовно основних позитивних та негативних аспектів існування процедури укладення шлюбного договору. У статті зроблено висновок щодо хибності існуючих у суспільстві стереотипів стосовно наслідків підписання шлюбного контракту. Розроблено систему рекомендацій щодо вдосконалення існуючої законодавчої бази, що регулює поняття шлюбного договору та особливості процедури його укладення. Запропоновано варіанти можливого законодавчого визначення терміна «шлюбний договір».uk
