dc.description.abstractУ статті досліджено актуальну проблему міжнародно-правового регулювання статусу біженців. Автори акцентують увагу на зростанні значення теми, що досліджується в умовах глобальних збройних конфліктів та політичних криз, зокрема в контексті повномасштабного вторгнення РФ в Україну у 2022 році. Внаслідок цього мільйони українців набули статусу біженців, що додатково ускладнило глобальну систему міжнародного захисту. В статті проаналізовано міжнародно-правові механізми регулювання статусу біженців, виявлено наявні проблеми в зазначеній сфері та запропоновано шляхи їх удосконалення. Об’єктом дослідження виступають міжнародно-правові відносини у сфері захисту біженців, предметом – міжнародні нормативні документи, договори, принципи і механізми, включно з діяльністю міжнародних організацій та досвідом окремих держав. Автори порівнюють визначення терміну «біженець», що передбачається в національному законодавстві України, Конвенції ООН «Про статус біженців» 1951 року та Протоколі 1967 року, наголошуючи на розбіжностях, що полягають у часових обмеженнях та географічному охопленні. Також детально розглянуто відмінності між дефініціями «біженець», «вимушений переселенець» і «мігрант», які суттєво відрізняються за причинами переміщення та обсягом наданого правового захисту. У центрі дослідження перебувають основні міжнародні нормативно-правові акти, що регулюють дане питання, а саме: Конвенція ООН 1951 року, Протокол 1967 року, Загальна декларація прав людини, Європейська конвенція з прав людини та діяльність Управління верховного комісара ООН у справах біженців (УВКБ ООН). Зокрема, Конвенція 1951 року визначає не лише сам термін, а й комплекс прав біженців, включаючи доступ до праці, освіти та соціального захисту, підкріплений принципом недопущення примусового повернення (non-refoulement). Окрему увагу приділено ролі УВКБ ООН, що здійснює моніторинг, надає гуманітарну допомогу та сприяє реалізації прав біженців в практичній площині. Європейський суд з прав людини також відіграє значну роль у створенні прецедентної практики захисту біженців. Стаття не лише узагальнює міжнародно-правові підходи, але й містить пропозиції щодо вдосконалення національного законодавства України у сфері захисту біженців, що є надзвичайно важливим у сучасних умовах.
dc.description.abstractotherThe article examines the current problem of international legal regulation of the status of refugees. The authors focus on the growing importance of the topic under study in the context of global armed conflicts and political crises, in particular in the context of the full-scale invasion of Ukraine by the Russian Federation in 2022. As a result, millions of Ukrainians have acquired refugee status, which has further complicated the global system of international protection. The article analyzes international legal mechanisms for regulating the status of refugees, identifies existing problems in this area and suggests ways to improve them. The object of the study is international legal relations in the field of refugee protection, the subject is international regulatory documents, treaties, principles and mechanisms, including the activities of international organizations and the experience of individual states. The authors compare the definition of the term "refugee" provided for in the national legislation of Ukraine, the 1951 UN Convention Relating to the Status of Refugees and the 1967 Protocol, emphasizing the differences in time limits and geographical coverage. The differences between the definitions of "refugee", "forced displacement" and "migrant", which differ significantly in the reasons for displacement and the scope of legal protection provided, are also examined in detail. The study focuses on the main international legal acts regulating this issue, namely: the 1951 UN Convention, the 1967 Protocol, the Universal Declaration of Human Rights, the European Convention on Human Rights and the activities of the Office of the United Nations High Commissioner for Refugees (UNHCR). In particular, the 1951 Convention defines not only the term itself, but also a set of refugee rights, including access to work, education and social protection, supported by the principle of non-refoulement. Particular attention is paid to the role of UNHCR, which monitors, provides humanitarian assistance and promotes the implementation of refugee rights in practice. The European Court of Human Rights, as the authors emphasize, also plays a significant role in creating precedents for refugee protection. The article not only summarizes international legal approaches, but also contains proposals for improving the national legislation of Ukraine in the field of refugee protection, which is extremely important in modern conditions.
